    THAT the Minutes of the Regular Council Meeting of April 9th, 2024 be adopted as circulated.

Councillor Trahan advised that Community Clean-Up Day was a success. Prizes will be handed out this weekend. 

Deputy Mayor Rooyakkers advised that Good Exchange Day, Amnesty Day and the Flea Market were all successful.  

Kevin Morphet from the Nosbonsing Curling Club made a presentation to Council regarding an update to the Curling Club's Capital Investment Plans.

Mayor Rochefort arrived at 5:23 p.m.

    THAT Council for the Municipality of East Ferris accepts the recommendation from the Director of Community Services contained in Report No. PLAN-2024-01 and approve, in part, the application from Jennifer and Bryan McLaughlin (owners of 52 Kyle Road) to purchase a portion of the road allowance between 50 Kyle Road and 52 Kyle Road in accordance with Schedule C of Report No. PLAN-2024-01 (Option #1); 

    AND FURTHER THAT the land be disposed of in accordance with the policies contained in By-law No. 2218.

    THAT Council for the Municipality of East Ferris accepts the recommendation from the Municipal Engineer contained in Report No. R-2024-05 and award Request for Quote EF 2024-03 for the supply and application of dust control and road stabilization materials to Pollard Hwy Products in the amount of $58,535.98 including H.S.T. for the volume required by the Municipality of East Ferris; 

    AND THAT the 2024 budget line item for crack sealing be reduced to account for the increased cost for dust control.

    THAT Council for the Municipality of East Ferris accepts the recommendation from the Municipal Engineer contained in Report No. R-2024-06 and award Tender EF 2024-04 for the supply of stockpile granular materials to Evan Hughes Excavating in the amount of $37,788.90 including H.S.T. for the tonnage required by the Municipality of East Ferris.

    THAT Council for the Municipality of East Ferris accepts the recommendation from the Municipal Engineer contained in Report No. R-2024-07 and award TENDER EF 2024-05: Winter Sand in the amount of $64,785.73 including H.S.T. to Miller Paving North Bay; 

    AND THAT the 2024 budget line item for crack sealing be reduced to account for the increased cost for winter sand.

    THAT By-law No. 2024-15 being a By-law to enter into an Automatic Aid Agreement between the Corporation of the Municipality of East Ferris and the Corporation of the Municipality of Callander, BE READ a third time and passed this 14th day of May, 2024;

    AND THAT said By-Law be signed by the Mayor and Clerk, and sealed with the Seal of the Corporation.

    WHEREAS Council for the Municipality of East Ferris deems it expedient to pass three readings of the following by-law at this session; 

    BE IT HEREBY RESOLVED THAT a By-law to deem Lots 17, 28-38, 76-78, 80-96, and 146-161 on Registered Plan M181 not to be lots on a registered Plan of Subdivision now in the Municipality of East Ferris in the District of Nipissing. Further, this By-law deems those portions of Ashwood Avenue, Beechwood Avenue, Elmwood Avenue, Poplar Road, Balsam Road and all laneways located between lots 17, 28-38, 76-78, 80-96 and 146-161, as shown on Plan M181, to not be registered as part of a Plan of Subdivision in the Municipality of East Ferris, BE READ a first, second and third time, passed and numbered 2024-19;

    AND THAT said by-law be signed by the Mayor and Clerk and sealed with the Seal of the Corporation.

    WHEREAS Council for the Municipality of East Ferris deems it expedient to pass three readings of the following by-law at this session; 

    BE IT HEREBY RESOLVED THAT a By-law to authorize the execution of an agreement between the Corporation of the Municipality of East Ferris and His Majesty the King in Right of Canada for funding through the Active Transportation Fund for new active transportation infrastructure connecting MacPherson Drive to the Voyageur Cycle Route and the Corbeil Outdoor Recreation Hub, BE READ a first, second and third time, passed and numbered 2024-20;

    AND THAT said by-law be signed by the Mayor and Clerk and sealed with the Seal of the Corporation.

    THAT Council for the Municipality of East Ferris support the resolution from the City of St. Catharines regarding petitioning the provincial government to implement provincial regulations to restrict the possession, breeding, and use of non-native (“exotic”) wild animals and license zoos in order to guarantee the fair and consistent application of policy throughout Ontario for the safety of Ontario’s citizens and the non-native (“exotic”) wild animal population; 

    AND FUTHER THAT that this resolution will be forwarded to all municipalities in Ontario for support, the Premier of Ontario, Ontario Solicitor General, Ontario Minister for Natural Resources and Forestry, MPP Anthony Rota, MPP Vic Fedeli, AMO, AMCTO, and MLEAO.

    THAT Council for the Municipality of East Ferris support the resolution from Hastings County calling on the Ontario and Federal Government to implement sustainable infrastructure funding for small rural municipalities;

    AND FURTHER THAT small rural municipalities are not overlooked and disregarded on future applications for funding;

    AND FURTHER THAT both the Federal and Ontario Governments begin by acknowledging that there is an insurmountable debt facing small rural municipalities;

    AND FURTHER THAT AND FINALLY THAT this resolution be forwarded to The Honourable Justin Trudeau, Prime Minister of Canada, The Honourable Sean Fraser, Minister of Housing, Infrastructure and Communities of Canada; Michel Tremblay Acting President and CEO, Canada Mortgage and Housing Corporation; The Honourable Doug Ford, Premier of Ontario; The Honourable Kinga Surma, Ontario Minister of Infrastructure; The Honourable Paul Calandra, Ontario Minister of Municipal Affairs and Housing; MP Anthony Rota, MPP Vic Fedeli, AMO, ROMA, FCM, Eastern Ontario Wardens’ Caucus, Good Roads and all Municipalities in Ontario.

    THAT Council for the Municipality of East Ferris supports the resolution from the Township of the Archipelago regarding requesting the Province reconsider and ultimately decide against the proposed phasing-out of free private drinking water testing services; 

    AND FURTHER THAT that this resolution be sent to all Ontario municipalities, Minister of Environment Conservation and Parks, Minister of Health, North Bay Parry Sound District Health Unit, MPP Nipissing.

    WHEREAS Jessica Jacques and Mark Donnelly have made a request to Council for an exemption under Section 4 of Municipal By-law 2015-33; a By-law to Prohibit Excessive Noise;

    AND WHEREAS with Jessica Jacques and Mark Donnelly's request, the exemption would only apply from Saturday, August 3rd, 2024 from 2:30 p.m. to Sunday, August 4th, 2024 at 12:30 a.m. and Section 1.1 on Sunday, August 4th, 2024 from 2:00 p.m. to 4:00 p.m for the purpose of a wedding to be held at 1003 MacPherson Drive;

    BE IT HEREBY RESOLVED that Council for the Municipality of East Ferris approve the request received from Jessica Jacques and Mark Donnelly and grant an exemption from Municipal By-law No. 2015-33 for Saturday, August 3rd, 2024 from 2:30 p.m. to Sunday, August 4th at 12:30 a.m. and Section 1.1 on Sunday, August 4th, 2024 from 2:00 p.m. to 4:00 p.m.

    (e)  litigation or potential litigation, including matters before administrative tribunals, affecting the municipality or local board; and

    WHEREAS Section 6.3 of the Municipality of East Ferris Procedural By-Law No. 2023-55 states that:  “Council shall adjourn its meeting at the hour of 8:00 p.m., if in session at that hour, save and except with the unanimous consent of members present”;

    AND WHEREAS Council at this time wish to continue the business of the agenda of May 14th, 2024; 

    THEREFORE BE IT HEREBY RESOLVED that Council agree to continue this Council meeting past the hour of 8:00 p.m.
