Mayor Rochefort called the meeting to order at 6:00 p.m.

    THAT the draft agenda presented to Council and dated the 23rd day of November, 2021 be adopted as amended with the following changes:

    • In-Camera session to be moved after item #6, Chair's Comments and add to in-camera session matter of Cassellholme Re-development under Section 239(2)(h) - information explicitly supplied in confidence to the municipality or local board by Canada, a province or territory or a Crown agency of any of them;
    • Add under section 14, resolution for NOHFC - Funding Application.

Council proceeded to In-Camera session at 6:03 p.m.  Municipal Solicitor and Manager of Planning and Economic Development joined in the In-camera session in order to discuss Ontario Land Tribunal Appeals.  After the discussion of the OLT appeal Council discussed the matter of Cassellholme Re-development.

    WHEREAS no public input was received at the public meeting of the Planning Advisory Committee meeting held November 17th, 2021 for File No. C-2021-04 Barbara Breault as the applicant for the lands described as EAST FERRIS CON 14 PT LOT 18 PCL 3661 W/F on what is locally known as 2667 Highway 17 East has applied for a zoning by-law amendment to rezone the property from Agricultural (A) to General Commercial Special Zone in order to permit a self storage business and an accessory residential home on the property;

    AND WHEREAS the application is consistent with the Provincial Policy Statement, 2014;

    AND WHEREAS the application is in conformity with the policies contained within the Official Plan for the Municipality;

    BE IT HEREBY RESOLVED that Council approves the recommendation from the Planning Advisory Committee Meeting held November 17th, 2021, Resolution No. 2021-36.

The Economic Development Committee recommended to Council to allow the committee to adopt a hybrid model for their quarterly meetings.  Council advised they had discussed this matter and will allow Boards and Committee to either meet in person or virtual up to January 15th, 2022.

    WHEREAS the Economic Development Committee recommended to Council to plan for an in-person Tradeshow for 2022 while ensuring all provincial and local COVID-19 health protocols and procedures are in place;

    BE IT HEREBY RESOVED that Council approves of this recommendation.

    WHEREAS the Municipality of East Ferris is in the process of adopting a new Comprehensive Zoning by-law;

    AND WHEREAS Short Term Rentals are currently prohibited and would be prohibited in the new by-law unless authorized by a zoning by-law amendment;

    AND WHEREAS Short Term Rentals were discussed in length at both the Open House on October 27th and the Planning Advisory Committee meeting on November 3rd, 2021 and are a point of concerns for the residents;

    AND WHEREAS the Economic Development Committee recommended to Council that the Planning Advisory Committee consider a permitting structure including licensing fees for Short Term Rentals in the new Comprehensive Zoning By-law rather than an outright prohibition without any other policies;

    BE IT HEREBY RESOLVED that Council approves of this recommendation.

The Committee met for their last meeting on Monday, Mayor Rochefort advised that the forecast is looking great for this day.  Deputy Mayor thanked all volunteers and the committee.  He encouraged the residents to participate and come to the tree lighting and the fireworks.

Mayor Rochefort advised that Council will unveil the New Municipal Building at the Centennial Celebration on November 27th, 2021.

During the discussion of the Police Services Board vacancy, Clerk advised Council that two other applications came in after the agenda was prepared and released.  Council deferred this item to the next Regular Meeting in order review all applications.

    THAT Council for the Municipality of East Ferris accepts the recommendation from the Manager of Planning and Economic Development contained in Report No. PLAN-2021-21 and sell a portion of the unopened road allowance south of 106 Cedar Bay Road to Mr. Bon at a reduced rate in conjunction with a transfer of lands owned by Mr. Bon to the municipality for the purpose of establishing an appropriate full-sized turnaround for Cedar Bay Road.

    WHEREAS the Manager of Planning and Economic Development made a verbal report to Council regarding a follow up from Report No. Plan 2021-19 presented to Council at the Regular Meeting held October 12th, 2021;

    AND WHEREAS Council passed resolution 2021-287 approving the sale of land in accordance with the recommendation contained within report PLAN-2021-19;

    AND WHEREAS there are existing roadways and laneways on a registered plan of subdivision, Plan M-180, as shown on the schedule attached to this resolution that need to be closed and deemed surplus in order to execute the consolidation of all of the lands within this area as outlined in report PLAN-2021-19;

    AND WHEREAS Mann Ave, Canada Ave, Gibson Place and Minto Place, as shown on Plan M-180, as well as all laneways shown on the attached part of Plan M-180, should be deemed surplus in order to continue with the consolidation of these lands;

    BE IT HEREBY RESOLVED that Council approves of Mr. Kirton's verbal report and deems the above mentioned roadways and laneways to be surplus and Mr. Kirton be authorized to proceed with the consolidation of these lands.

    WHEREAS Council for the Municipality of East Ferris deems it expedient to pass three readings of the following By-law at this session; BE IT HEREBY RESOLVED THAT a By-law to authorize the execution of a Lease Agreement between the Corporation of the Municipality of East Ferris and Roger's Communications Incorporated for the use of Municipal land on which to operate and maintain a Communication Tower, Building and Antennas, BE READ a first, second and third time, passed and numbered 2021-54;

    AND THAT said By-law be signed by the Mayor and Clerk and sealed with the Seal of the Corporation.

    WHEREAS Council for the Municipality of East Ferris deems it expedient to pass three readings of the following by-law at this session; BE IT HEREBY RESOLVED THAT a By-law to close and convey a part of the Original Shoreline Road Allowance in front of Plan M475, Lot 15, Pcl 12832 W/F, East Ferris, District of Nipissing, described as Part 2, Plan 36R-14661 known as 1386 Hemlock Island, BE READ  a first, second and third time, passed and numbered 2021-55;

    AND THAT said by-law be signed by the Mayor and Clerk and sealed with the Seal of the Corporation.

    THAT the Municipality of East Ferris supports the letter received from CUPE Ontario President Fred Hahn and call for an immediate, comprehensive and independent third-party expert review of OMER'S Investment performance and practices over the past ten years, conducted by the OMERS Pension Plan's sponsors and stakeholders;

    AND FURTHER that the Municipality of East Ferris calls on the OMERS Administration Corporation to:

    • Provide all requested data, documentation and information required of the review panel to fulfill its mandate;
    • Establish a step-by-step plan, with OMERS sponsors and stakeholders, to implement any recommendations set out in the review report.

    WHEREAS Stop-Arm Camera Systems are a major part of creating safer school buses and safer roads for all area residents;

    AND WHEREAS Bill 174 received Royal Assent on December 12th, 2017, under Schedule 4 Amendments to the Highway Traffic Act by adding a new Part providing for the use of automated school bus camera systems;

    AND WHEREAS given the district courts are in North Bay, it is imperative that the City of North Bay come on board with a Stop-Arm Camera Program so that other municipalities within the Nipissing District can move forward to help keep the children in communities safe;

    BE IT HEREBY RESOLVED that the Municipality of East Ferris request the City of North Bay to look into the process of implementing a stop-arm camera program with BusPatrol for the City with the goal of developing a regional program to ensure coverage of all school buses within the collective municipalities;

    AND FURTHER that this resolution be forwarded to FONOM, OGRA, Let's Remember Adam, Stop for School Buses, BusPatrol and municipalities that form part of the Provincial Offences Act (POA) through the City of North Bay.

    THAT Council for the Corporation of the Municipality of East Ferris authorizes staff to submit a funding application to Northern Ontario Heritage Fund Corporation (NOHFC) for the East Ferris Medical Centre project with a total project cost of $3,134,156 and a requested NOHFC contribution of $1,384,578.
