Mayor Rochefort called the meeting to order at 6:00 p.m. and welcomed everyone in attendance, as well as the public watching the meeting from livestream.  Deputy Mayor Voyer and Councillor Steven Trahan were absent for this Council meeting.

Mayor Rochefort advised that she attended the AMO Virtual Conference with Councillor Lougheed in August.  It was a good Conference.  Mayor Rochefort did a brief report of the conference.

    WHEREAS no public input was received during the public meeting for Zoning By-law Amendment, File No. C-2020-01 (1851477 Ontario Inc.) at the Planning Advisory Committee Meeting held August 19th, 2020;

    AND WHEREAS the Planning Advisory Committee is of the opinion that the proposal is consistent with Provincial Policy Statement 2014 and is in conformity with the policies contained within the Official Plan for the Municipality; 

    BE IT HEREBY RESOLVED that the lands described as  Con. 4, Pt Lot 15, 36R6314 Parts 1 and 2, Rem Pcl 14743 WFPCL 16011 WF 36R7781 Parts 1 and 2, Pcl 17425 WF on what is locally known as 645 Astorville Road be approved for Zoning By-law Amendment to facilitate the expansion of the permitted commercial uses on the property including a medical office, pharmacy, fitness centre, daycare and accessory commercial uses.

NOTICE OF MOTION PREPARED BY MAYOR ROCHEFORT

    WHEREAS the Municipality of East Ferris enacted Bylaw #1486 to ensure the upkeep of property within the Municipality of East Ferris;

    AND WHEREAS the lack of upkeep of a property can lead to the degradation of a neighbourhood and of a community;

    AND WHEREAS citizens of Astorville are complaining and upset about the upkeep of the former school property on Village Road;

    NOW THEREFORE BE IT RESOLVED that:

    1. Staff urgently enforce the Municipality’s Property Standards By-law related to the former school property on Village Road in Astorville and impose the necessary fines.
    2. If the Municipality’s Property Standards By-law is deemed to be deficient in order to rectify the situation, staff prepare a revised By-law.

NOTICE OF MOTION PREPARED BY MAYOR ROCHEFORT.

Notice of Motion was moved and seconded in order to start the debate on the motion.  After debate, the Notice of Motion presented by Mayor Rochefort was deferred to a future Council Meeting.  Council is requesting legal opinion prior to proceeding with this motion.

    WHEREAS the Municipality of East Ferris’ Official Plan states that unless it is clearly in the public interest for the Municipality, it is not intended that existing private roads will be assumed by the Municipality and no responsibility for access, snow removal, maintenance or use by school buses is acknowledged. Where, however, the Municipality chooses to assume a private road, the road must first be improved to the standards for Municipal roads.  Roads on lands under plan of subdivision may be assumed by the Municipality provided the standards for road construction have been satisfactorily met;

    AND WHEREAS the standards for new road construction include a minimum of 20 metres (66 feet) right-of-way, engineered design and layout, appropriate drainage and construction;

    AND WHEREAS the Municipality’s Official Plan states that no construction, alteration or maintenance of the Municipal roadway shall be permitted without the expressed permission of the Municipality;

    AND WHEREAS the Municipality of East Ferris has three roads (Birch Hill, Gauthier and Ashwood) that form part of its Municipal Road Inventory that are not up to municipal standards, are being maintained by residents, and for which no expressed permissions of use have been authorized;

    AND WHEREAS the Municipality of East Ferris owns a parcel of land that was transferred to the Municipality in 2015 which was and continues to be used as a road (One Mile Road) and maintained by residents, and for which no expressed permissions of use have been authorized;

    NOW IT IS HEREBY RESOLVED THAT staff be directed to examine the options to move forward and suggest a plan of action with proposed timelines. Note in passing this Motion, Council understands the financial implications and therefore directs staff to identify only immediate priorities. A longer term horizon as well as a staged approach is encouraged where future action is deemed appropriate and necessary.

    WHEREAS the Municipality of East Ferris recognizes that the pandemic has exposed weaknesses in the system that employs over 100,000 people across Ontario that oversees caring for a medically complex population of approximately 78,000 residents in Long Term Care homes;

    AND WHEREAS the Municipality of East Ferris is home to privately owned Nipissing Manor Nursing Care Centre, is a member municipality of Cassellholme Home for the Aged and is home to many senior residents who are concerned about their future wellbeing as they consider residency in LTC facilities;

    AND WHEREAS the Ontario government launched an independent commission into COVID-19 and long-term care;

    NOW THEREFORE BE IT HEREBY RESOLVED that the Municipality of East Ferris write to Commissioners Associate Chief Justice Frank N. Marrocco (Chair), Angela Coke and Dr. Jack Kitts with copy to Premier Ford, Dr. Merrilee Fullerton, Minister of Long-Term Care and MPP Vic Fedeli to encourage the following action:

    • A review of the Direct Funding Agreement that governs the funding of LTC homes;
    • Implementation of policies that ensure that LTC homes are a healthy place to live and work, and
    • Implementation of staffing approaches that reflect and respond to the complexity of the sector and diverse resident needs.

    WHEREAS the Municipality of East Ferris received a resolution from the Corporation of the City of North Bay supporting the Federation of Canadian Municipalities' (FCM) request asking the Federal Government to support communities with a minimum of $10 billion funding for emergency operational support;

    BE IT HEREBY RESOLVED that Council of the Municipality of East Ferris supports the City of North Bay's resolution;

    AND FURTHER that a copy of this resolution be forwarded to the Federation of Northern Ontario Municipalities (FONOM), Association of Municipalities of Ontario (AMO), MP Anthony Rota, and MPP Vic Fedeli.

    WHEREAS  local city and town councils, big or small, rural or urban are on the front lines
    of some of the most pressing challenges facing Canada;

    AND WHEREAS municipal workers are going flat out to deliver the public services that keep us safe during the COVID-19 crisis;

    AND WHEREAS municipal revenues are collapsing and unanticipated costs are soaring;

    AND WHEREAS without financial help, cities and towns will be forced to cut vital local services our families and communities rely upon;

    AND WHEREAS public transportation makes our communities more livable and fights climate change; 

    BE IT HEREBY RESOLVED that the Municipality of East Ferris calls for the provincial and federal governments to provide emergency operating funds to protect vital local services, including public transportation and emergency services.

    WHEREAS Council for the Municipality of East Ferris deems it expedient to pass three readings of the following by-law at this session; BE IT HEREBY RESOLVED THAT a By-law to confirm the proceedings of Council from August 11th, 2020 to September 8th, 2020, BE READ  a first, second and third time, passed and numbered 2020-28;

    AND THAT said by-law be signed by the Mayor and Clerk and sealed with the Seal of the Corporation.
